KRASHFAB, LLC
WAIVER OF LIABILITY AND HOLD HARMLESS AGREEMENT
In purchasing a KRASHFAB, LLC product, your acceptance of this product, confirms you acknowledge and represent that you agree and accept voluntarily the Waiver of Liability and Hold Harmless Agreement as follows:

You are fully aware, the purchase of this KRASHFAB, LLC product is not an Original Equipment Manufacturer (OEM) product and has not been reviewed, approved and is not in compliance with the Department of Transportation (DOT) standards. This product is designed for Off-Road use Only.

You are fully aware that a “product” of KRASHFAB, LLC includes, but is not limited to, any manufacturing, modification, design, or customization, conducted by KRASHFAB, LLC, and is non-reversable once completed.

You are fully aware of the risks or damage arising with the use of non-OEM/DOT products and you elect to voluntarily engage in such use of this product, knowing that the use may be hazardous to yourself and/or your property. You voluntarily assume full responsibility for any risks of loss, property damage or personal injury, including death, that may be sustained by you (or anyone else) as a result of using this product, whether caused by negligence of representatives or otherwise.

You are fully aware and acknowledge that the use of the product and intended use for the vehicle, is for off-road use only. You understand and recognize that off-road parts, specialized off-road equipment, and all parts and services sold by KRASHFAB, LLC are exposed to many and varied conditions due to the manner in which they are installed and used. You understand and agree that any product is not intended for the use of vehicles which can legally be used on public streets or highways. No product or services by KRASHFAB, LLC is designed or intended to prevent injury or death.

You release, waive, discharge and covenant not to sue KRASHFAB, LLC officers, members, servants, agents, or employees (hereinafter referred to as representatives ) from any and all liability, claims, demands, actions, and causes of actions whatsoever arising out of or related to any loss, damage or injury, including death, that may be sustained by you, (or anyone else), or any property belonging to you (or anyone else) whether caused by the negligence of representatives or otherwise, while working on, using or any use related to this product.

You further agree to indemnify and hold harmless the representatives from any loss, liability, damage or costs, including court costs and attorney fees, that may be incurred due to your use of this product, whether caused by the negligence of representatives, or otherwise.

You expressly intend that this Release and Hold Harmless Agreement shall bind the members of your family and spouse, including your heirs assigns and personal representatives, and shall be deemed a release, waiver discharge and covenant not to sue the above-named representatives. You further agree that this Waiver of Liability and Hold Harmless Agreement shall be construed in accordance with the law of the State of California.

You agree that by accepting this product you confirm you are at least (18) years of age and fully competent and accept the terms herein with complete consideration fully intending to be bound by the same.
- You agree to pay all invoices within 10 days of job completion. Failure to do so will be billed at 1.5% interest monthly, compounded. Vehicles/projects shall not be picked up until invoices are paid. Storage fees shall be charged at $10 per day
